These Terms govern your use of the Nexus Protocol mobile application. By creating an account or using the app, you agree to these Terms. If you do not agree, please do not use the app. Plain language. No traps. No fine-print theater. Just the rules of the road.

1. The agreement

These Terms govern the relationship between you and Nexus Protocol, operated from Barcelona, Spain ("we", "us", "our"), governing your use of the Nexus Protocol mobile application (the "App").

2. Eligibility

You must be at least 16 years old to use the App. By creating an account, you confirm that you meet this requirement. If we learn that an account belongs to someone under 16, we will delete it.

4. What the App does — and what it does not

4.1 What it offers

Nexus Protocol is a personal evaluation and reflection tool. It generates a symbolic and analytical reading of your responses, a classification, and optional creative outputs (such as portraits, narrative chapters, and signal feedback). It is intended as a contemplative, artistic, and introspective experience.

4.2 What it is NOT

Nexus Protocol is not a medical, psychological, psychiatric, legal, financial, or therapeutic service. Its outputs are not diagnoses, prescriptions, predictions of behavior, or professional advice of any kind. Nothing in the App should be used as a substitute for guidance from a qualified professional. If you are experiencing distress, please reach out to a doctor, therapist, or local emergency line.

5. Subscriptions, purchases, and refunds

5.1 In-app purchases

The App offers optional purchases through Apple's App Store, including a one-time Dossier unlock (currently $4.99), a Full Access yearly subscription (currently $9.99/year), and a Re-Evaluation Pass. Prices may vary by region and currency. The current price is always displayed in the App before you confirm a purchase.

All purchases are processed by Apple. Refund requests must be submitted directly to Apple at reportaproblem.apple.com. We have no ability to issue refunds ourselves. We do not provide refunds for unused portions of subscriptions.

7. Intellectual property

The App, its design, code, written text, audio, AI-generated visuals, classification system, and overall identity are the exclusive property of Nexus Protocol and are protected by copyright, trademark, and other intellectual-property laws.

You receive a limited, personal, non-exclusive, non-transferable license to use the App on devices you own or control, for your own non-commercial use. No other rights are granted.

8. Your content

When you provide answers, prompts, or other inputs in the App, you retain ownership of your inputs. You grant us a limited license to process those inputs strictly to provide the App's functionality (for example, to generate your evaluation result or your portrait). We do not use your inputs to train external AI models, and we do not share them with advertisers or data brokers.

9. AI-generated content disclaimer

Some outputs of the App — including symbolic readings, portraits, and narrative texts — are generated using artificial intelligence. AI-generated content can contain errors, inaccuracies, or imaginative interpretations. Treat all such outputs as artistic and reflective material, not as factual statements about you or anyone else.

10. Service availability

We do our best to keep the App available and functional, but we offer no guarantee of uninterrupted service. We may modify, suspend, or discontinue parts of the App at any time, with or without notice. We may release updates, fixes, and new features at our discretion.

11. Termination

You may stop using the App and delete your account at any time. We may suspend or terminate your access if you violate these Terms, attempt to harm the service or other users, or in cases of suspected fraud. On termination, your access ends; your data is handled according to our Privacy Policy.

12. Disclaimers

THE APP IS PROVIDED "AS IS" AND "AS AVAILABLE", WITHOUT WARRANTY OF ANY KIND, EITHER EXPRESS OR IMPLIED, INCLUDING WITHOUT LIMITATION ANY WARRANTY OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, OR NON-INFRINGEMENT. WE DO NOT WARRANT THAT THE APP WILL BE ERROR-FREE, SECURE, OR UNINTERRUPTED.

13. Limitation of liability

To the maximum extent permitted by applicable law, in no event shall we be liable for any indirect, incidental, special, consequential, or punitive damages, including but not limited to lost profits, data, or goodwill, arising from or in connection with your use of the App, even if we have been advised of the possibility of such damages.

Our total cumulative liability arising out of or relating to these Terms or the App shall not exceed the greater of (a) the amount you paid us in the 12 months preceding the claim, or (b) twenty euros (€20).

14. Apple-specific terms

You acknowledge that these Terms are between you and us, not with Apple, and that Apple is not responsible for the App or its content. Apple has no obligation to provide maintenance or support for the App. In the event of any failure of the App to conform to any applicable warranty, you may notify Apple, and Apple will refund the App's purchase price (if any) to you. Apple shall have no other warranty obligation. Apple and Apple's subsidiaries are third-party beneficiaries of these Terms and may enforce them against you.

15. Governing law and disputes

These Terms are governed by the laws of Spain, without regard to its conflict-of-law rules. Any dispute arising from or relating to these Terms or the App shall be brought before the competent courts of Barcelona, Spain, unless mandatory consumer-protection laws of your country of residence grant you the right to bring proceedings elsewhere.

16. Changes to these Terms

We may update these Terms from time to time. The latest version will always be available at this URL, with an updated date at the top. For material changes, we will notify you in the App or by email before the changes take effect. Continued use of the App after changes take effect constitutes acceptance of the new Terms.
